Terms and conditions

This is a translation for convenience. The German version is legally binding.

§ 1 Scope and provider

These terms apply to all orders placed on the website easycaredits.com. The provider and contracting party is Schmitko OHG, Heilig-Brünnle-Straße 50, 72461 Albstadt, Germany (see legal notice).

§ 2 Service

From 3 to 9 photos of a parked vehicle (3 to 6 photos for motorcycles), an artificial intelligence creates a video in the chosen style. The video has the chosen length of 5, 10 or 15 seconds, portrait format 9:16, 1080p resolution and no sound. The vehicle does not move in the video; all movement comes from the camera. Only the views of the vehicle that appear in the photos are shown.

§ 3 Conclusion of contract

The presentation on the website is not a binding offer. By clicking the order button, the customer makes a binding offer. The contract is concluded when we confirm the order by email or start creating the video.

§ 4 Prices and payment

The prices shown at the time of ordering apply. They are EUR 9.99 for 5 seconds, EUR 14.99 for 10 seconds and EUR 19.99 for 15 seconds (9,99 / 14,99 / 19,99 euros), each including statutory VAT. Payment is made before creation via the payment service Stripe. Creation only begins once payment has been received.

§ 5 Customer photos

The customer only uploads photos for which they hold the necessary rights and which do not infringe the rights of third parties. No persons should be recognisable in the photos. The customer indemnifies us against third-party claims arising from a breach of these obligations, insofar as the customer is responsible for the breach. We use the photos only to create the ordered video and to check a complaint. We delete them together with the video 30 days after completion.

If we are notified that photos or the video infringe the rights of third parties or are otherwise illegal (see legal notice, "Reporting infringements"), we review the notice. If it is justified, we delete the photos and the video before the 30 days have expired and inform the customer of this and the reasons for it.

§ 6 AI creation and deviations from the original

The video is created entirely by an artificial intelligence. Deviations from the photographed vehicle can occur. Small changes to the vehicle are possible and are part of the service. This applies in particular to lettering, logos, badges and embossing on the vehicle, the lettering and tread of the tyres, the brake calipers and their lettering, the wheels and their details, decals, wraps and stickers, the licence plate, details in areas that are small, blurred or not visible in the photos, and the background.

We point out these deviations separately before the order. The customer expressly agrees to them and to these terms before ordering and before creation begins; without this consent no video is created. They therefore form part of the agreed characteristics of the video. No new video is created for such deviations.

If the video shows a clearly different vehicle from the photos, we refund the amount paid. The customer's statutory rights in respect of defects in digital products (§§ 327 et seq. German Civil Code) otherwise remain unaffected.

§ 7 Provision

The finished video is available for download for 30 days after creation. It is then deleted. The customer is responsible for saving the video within this period.

§ 8 Rights of use

The customer receives a simple right, unlimited in time and territory, to use the video for their own purposes, including publication on social networks. In doing so, the customer observes the rules of the respective platform on labelling AI-generated content.

§ 9 Right of withdrawal

Consumers have a right of withdrawal in accordance with the withdrawal policy. The right of withdrawal expires when we begin creating the video after the customer has expressly agreed that we may begin before the withdrawal period ends and has confirmed their knowledge that they thereby lose their right of withdrawal.

§ 10 Liability

We are liable without limitation for intent and gross negligence, for injury to life, body or health and under the German Product Liability Act. In the case of slight negligence, we are only liable for breach of essential contractual obligations, the fulfilment of which makes the proper performance of the contract possible in the first place and on whose observance the customer may regularly rely. In this case, liability is limited to the foreseeable damage typical for the contract.

§ 11 Final provisions

The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice of law applies only insofar as it does not deprive them of the protection of mandatory provisions of the country in which they have their habitual residence. We do not take part in dispute resolution proceedings before a consumer arbitration board.
